(“BFE,” “we,” “us,” or “our”)

Banger Firearms & Engraving, LLC operates in strict compliance with all applicable federal, state, and local laws governing the sale, shipment, and transfer of firearms, firearm parts, ammunition, and related accessories.

​

By placing an order with Banger Firearms & Engraving, LLC, the customer (“Buyer” or “you”) acknowledges that they have read, understood, and agreed to these Terms of Sale in their entirety.

1. LEGAL COMPLIANCE & CUSTOMER RESPONSIBILITY

 

The Buyer is solely responsible for ensuring that the purchase, shipment, transfer, possession, ownership, and use of any item purchased from Banger Firearms & Engraving, LLC complies with all applicable federal, state, and local laws, regulations, and ordinances.

 

Banger Firearms & Engraving, LLC makes no representation or warranty regarding the legality of any item in any specific jurisdiction. These Terms are not legal advice.

The Buyer affirms that they have independently verified the legality of the item(s) purchased in their jurisdiction prior to placing an order.

 

 

2. ELIGIBILITY TO PURCHASE FIREARMS

 

By placing an order, the Buyer affirms and certifies that:

1. They are not prohibited under federal, state, or local law from purchasing, possessing, or receiving firearms or ammunition.

2. They understand that attempting to purchase a firearm while prohibited may result in criminal penalties and permanent loss of funds.

 

If you have any reason to believe you may be prohibited, you are strongly encouraged to consult a qualified attorney or complete the purchase through a local dealer prior to ordering online.

 

 

3. AGE REQUIREMENTS

1. Must be 18 years of age to purchase rifles or shotguns.

2. Must be 21 years of age to purchase handguns.

 

 

4. PAYMENT TERMS

 

All payments are processed immediately upon order placement. Orders will not be shipped until payment has cleared.

 

 

5. FIREARM SALES & TRANSFERS

 

Sale vs. Transfer Clarification

The purchase of a firearm constitutes a commercial sale, not a guarantee of transfer or possession.

The transfer of a firearm is a separate legal process governed by federal and state law and is subject to approval by:

1. The receiving Federal Firearms Licensee (“Receiving FFL”), and

2. Any required background check (including NICS or state equivalents)

 

Banger Firearms & Engraving, LLC has no control over and bears no responsibility for the outcome of any background check or transfer decision.

 

 

6. SHIPPING TO A RECEIVING FFL

1. Firearms purchased online must be shipped to a valid FFL chosen by the Buyer.

2. The Buyer is responsible for contacting their Receiving FFL before ordering to confirm:

   • Transfer acceptance

   • Transfer fees

   • Any additional local requirements

 

Any refusal or failure by a Receiving FFL to accept or transfer a firearm is the sole responsibility of the Buyer.

 

 

7. DENIED OR REFUSED TRANSFERS — ALL SALES FINAL

ALL FIREARM SALES ARE FINAL UPON SHIPMENT. NO EXCEPTIONS.

 

If a firearm is denied, delayed indefinitely, or refused for transfer by a Receiving FFL or due to a failed or delayed background check:

1. The Buyer is not entitled to a refund

2. Banger Firearms & Engraving, LLC is not responsible for the denial or refusal

3. The Buyer assumes all responsibility and costs, including but not limited to:

   • Return shipping

   • Storage fees

   • Restocking fees

   • Administrative costs

 

DISPOSITION OF FIREARMS AFTER DENIAL OR REFUSAL

 

A. Denied or Refused Transfer at a Third-Party FFL

If a firearm is shipped to a third-party Federal Firearms Licensee (“Receiving FFL”) selected by the Buyer and the transfer is denied, delayed, or refused for any reason:

1. Banger Firearms & Engraving, LLC bears no responsibility for the denial or refusal.

2. No refund will be issued.

3. Banger Firearms & Engraving, LLC is not required to accept return of the firearm from the Receiving FFL.

4. The Buyer assumes all responsibility and costs, including but not limited to return shipping, storage fees, transfer fees, administrative fees, and any other expenses imposed by the Receiving FFL.

Any disposition of the firearm following a denial at a third-party FFL is governed by applicable law and the policies of the Receiving FFL. Banger Firearms & Engraving, LLC has no obligation to intervene, retrieve, or retransfer the firearm.

 

 

B. Denied or Refused Transfer at Banger Firearms & Engraving, LLC

If a firearm transfer is denied or refused at the premises of Banger Firearms & Engraving, LLC, the firearm shall remain the property of Banger Firearms & Engraving, LLC.

In such cases:

1. Banger Firearms & Engraving, LLC may, at its sole discretion, offer a limited refund, less any applicable fees, costs, or expenses.

2. Banger Firearms & Engraving, LLC retains the unrestricted right to resell the firearm to another legally eligible, non-prohibited purchaser.

3. No refund is guaranteed, and any refund determination is made solely at the discretion of Banger Firearms & Engraving, LLC.

 

 

C. General Disposition Authority

Except where prohibited by law, Banger Firearms & Engraving, LLC retains sole discretion over the disposition of any firearm subject to a denied or refused transfer, which may include:

1. Return shipment at the Buyer’s expense

2. Transfer to an alternate FFL where legally permitted

3. Resale of the firearm

 

Any resale proceeds, if applicable, may be reduced by all associated costs, fees, storage charges, administrative expenses, and restocking fees.

 

 

8. CANCELLATIONS & REFUNDS

1. A $75 restocking fee applies to any canceled firearm order prior to shipment

2. NO REFUNDS on any firearm once it has shipped

3. Manufacturer defects must be handled directly through the manufacturer

 

 

9. TRANSFER FEES

1. Firearm transfers for firearms purchased from Banger Firearms & Engraving, LLC: No charge

2. Firearm transfers for firearms not purchased from BFE: $50

3. No NFA items

 

 

10. CHARGEBACKS & PAYMENT DISPUTES

 

The Buyer agrees not to initiate a chargeback or payment dispute related to:

1. Denied or refused firearm transfers

2. Background check delays or failures

3. Actions or decisions of a Receiving FFL

 

Any chargeback initiated in violation of these Terms constitutes a breach of contract, and the Buyer will be responsible for all resulting fees, costs, and collection expenses.

 

 

11. INDEMNIFICATION

 

The Buyer agrees to indemnify, defend, and hold harmless Banger Firearms & Engraving, LLC, its owners, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including attorney’s fees) arising from:

1. A denied or refused firearm transfer

2. The Buyer’s legal eligibility or status

3. Actions or decisions of the Receiving FFL

4. Any violation of applicable laws

5. Any payment dispute or chargeback

 

 

12. SHIPPING TIMES

 

Orders typically ship within 3–5 business days, subject to availability and seasonal volume. Shipping times are estimates only.
